Trainly Terms of Use

Effective date: November 1, 2026
Last updated: November 1, 2026

Version française : trainlyfitness.com/fr/terms

These Terms of Use (“Terms”) are an agreement between you and Trainly Fitness Inc. (“Trainly”, “we”, “us”, “our”), a corporation incorporated under the Canada Business Corporations Act. They cover your use of the Trainly app and website (together, “Trainly”).

By creating an account or using Trainly, you agree to these Terms and to our Privacy Policy, which explains how we handle your personal information. If you do not agree, please do not use Trainly.

If you live in Quebec, or elsewhere where consumer protection law gives you rights that these Terms cannot take away, nothing in these Terms limits those rights.

1. Who can use Trainly

  • You must be at least 13 years old.

  • If you are under the age of majority where you live, you may use Trainly only with the permission of a parent or guardian. That parent or guardian agrees to these Terms for you, and is responsible for your use of Trainly.

  • You may not use Trainly if we have previously closed your account for breaking these Terms, or if the law prohibits you from using it.

  • If you use Trainly for a gym, studio, facility, club or other business, you confirm you are authorised to act for it, and these Terms bind it as well as you.

2. Your account

  • Give accurate information when you sign up, and keep it up to date.

  • Sign up with an email address you will keep, because sign-in codes and password resets are sent there. If you lose access to it, contact us. We will help where we can confirm the account is yours, but we cannot always restore access.

  • Keep your password private. You are responsible for activity on your account. Tell us at once at support@trainlyfitness.com if you think someone else has used it.

  • One person per account, and do not sell, transfer or share your account.

  • Your username must not impersonate anyone, infringe anyone’s rights or be misleading or offensive. We may change or reclaim a username that breaks these Terms or that a business or person has a legal right to.

  • The “verified” badge means we have checked that an account belongs to the gym or person it names. It is not an endorsement, and we may remove it if the account no longer meets our requirements or breaks these Terms.

  • Apart from that badge, we do not check who users are, or their qualifications, background or abilities. Use your judgement when dealing with other users.

3. Health and safety

Trainly is a tool for logging, planning and sharing training. It does not give medical advice.

  • Exercise carries a risk of injury, and in rare cases serious harm. Talk to a doctor before starting a new programme, especially if you are pregnant, injured or have a medical condition.

  • Stop exercising and get help if you feel pain, faintness or shortness of breath.

  • Records, statistics, busyness levels, workout suggestions and templates, and anything trainers or other users post, are for information only. They may be inaccurate.

  • Train within your ability, use proper equipment and supervision, and follow the rules of the places you train.

  • Trainly does not organise, supervise or inspect the classes, sessions, challenges, duels or group workouts that users and Providers run or join through the app.

You are responsible for your own training decisions.

4. Trainers, gyms, clubs and bookings

Trainly lets you find and book trainers, coaches, instructors, gyms, studios, facilities and clubs (“Providers”), and lets Providers offer their services. When you book with a Provider:

  • Providers are independent. They are not Trainly’s employees, agents or partners. Trainly does not supervise, control or guarantee their services, qualifications, insurance or premises. A Provider’s profile, credentials and reviews are their own statements unless we say otherwise.

  • The agreement is between you and the Provider. Trainly provides the tools, and is not a party to that agreement.

  • Payment. Trainly does not currently take payments for sessions, classes or memberships. You pay the Provider directly, on the terms they set. Trainly does not process, hold or refund those payments, and is not responsible for them. If we introduce payments through Trainly, separate payment terms will apply and will be shown to you before you pay.

  • Cancellations, no-shows and attendance. Bookings follow the cancellation window and attendance rules shown in the app. The rules include:

    • check-in;

    • session codes;

    • reporting a no-show, and disputing a report.

    An account with repeated no-shows may lose access to free sessions and gym days, or to booking.

  • Keeping bookings on Trainly. To protect both sides, messages between members and trainers may not share contact details or arrange to book around Trainly. While Trainly does not take payment, you may tell each other how a session will be paid for. See the Privacy Policy for how these messages are checked.

  • If you are a Provider, you confirm that:

    • you hold any qualifications, licences, permits and insurance your services need;

    • your listings and prices are accurate;

    • you will honour your bookings and the free sessions or gym days you offer through Trainly;

    • you will follow the laws that apply to your business, including consumer protection, tax and privacy laws for any personal information you receive about members.

  • If you run a club, you are responsible for making sure that:

    • your club follows these Terms;

    • you have the right to use its name, logo and content;

    • it does not suggest it is run or endorsed by Trainly.

    We may remove a club, its content or its badge, or transfer it to someone with a better claim to it.

  • Disputes with a Provider are between you and them. We may, but are not required to, help resolve them.

5. Your content

You own what you post: photos, videos, workouts, comments, reviews and messages (“your content”).

The licence you give us. You give Trainly a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example, resize or format) and distribute your content, only to operate, improve and promote Trainly, and as your privacy settings and the features you use allow. For example, a public post may appear in Discover or be shown to members of a gym. We will not use your name, photos or videos in Trainly’s advertising outside the app without asking you first. We do not license your content to advertisers.

The licence ends when you delete the content or your account, except:

  • for content you shared with others, such as a post made together with someone else or a message you sent, which may stay visible to them;

  • for content we must keep by law.

Deleted content may remain in backups for up to 30 days.

Your promises. You confirm that:

  • you have the rights needed to post your content;

  • it does not break these Terms or the law;

  • you have permission from anyone identifiable in your photos and videos where the law requires it.

Feedback. If you send us ideas or suggestions, we may use them without owing you anything.

6. Community rules

Trainly is for fitness. Posts, stories, challenges and profiles must be related to fitness: training and exercise, sport and physical activity, nutrition, recovery, health and wellbeing as part of training, and life at your gym, studio or club. Comments and messages may be about anything, within the rules below. We may remove content that is not related to fitness, even if it breaks no other rule.

When using Trainly, you must not:

  1. harass, threaten, bully, intimidate, stalk or demean anyone, or promote hate based on race, ethnicity, religion, disability, sex, gender identity, sexual orientation or similar characteristics;

  2. post or send sexual content, nudity, or sexual content involving anyone under 18 (which we report to the authorities);

  3. post graphic violence, or promote self-harm, eating disorders, or dangerous or illegal substances or activities, including the sale of steroids or other controlled substances;

  4. impersonate any person or business, or misrepresent your qualifications or affiliation;

  5. post someone else’s private information, or photos or videos of people without their permission where it is required;

  6. infringe anyone’s copyright, trademark, privacy or other rights;

  7. spam, scam, run contests, lotteries or gambling, or advertise without our permission, buy or sell followers, or create accounts by automated means;

  8. log fake workouts, records, attendance, ratings or reviews, or otherwise game leaderboards, challenges, busyness or free benefits;

  9. get around our booking protections, blocks, privacy settings or safety checks;

  10. scrape, crawl, reverse-engineer, overload, interfere with, or try to gain unauthorised access to Trainly, other accounts or our systems, or introduce malware;

  11. use Trainly for anything illegal, or to help anyone else break these rules.

Reporting. You can report content and accounts in the app. Using Trainly means you may come across content that you find offensive. Please report it. A post, story or comment that enough different people report is hidden from others until we review it, as the Privacy Policy describes.

Copyright and trademark complaints. Email support@trainlyfitness.com (subject “Copyright”) with:

  1. your physical or electronic signature;

  2. the work or trademark you say is infringed;

  3. where the material is on Trainly, in enough detail for us to find it;

  4. your name, address, phone number and email address;

  5. a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;

  6. a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for them.

If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. It must include:

  • your name, address, phone number and signature;

  • what was removed and where it was;

  • a statement under penalty of perjury that you believe it was removed by mistake;

  • your consent to the jurisdiction of the courts as the US Digital Millennium Copyright Act requires.

For complaints about copyright under Canadian law, we follow the notice-and-notice rules of the Copyright Act. We close the accounts of repeat infringers where appropriate.

Enforcement. We may review content, but we are not required to monitor it. If we believe content or conduct breaks these Terms or the law, we may:

  • remove it;

  • warn you;

  • limit features;

  • suspend or close accounts;

  • report it to the authorities.

Where reasonable, we will tell you what we did and why. You can see every decision about your account or content in Settings → Account status, and appeal each one once. A person at Trainly reviews every appeal.

7. Trainly PRO and in-app purchases

  • Subscriptions. Trainly PRO is a paid subscription bought through the Apple App Store and billed monthly at the price shown in the app before you buy, including any applicable taxes. Other plans, including plans for businesses, may be offered at the price and on the conditions shown.

  • Automatic renewal. Your subscription renews automatically each month and Apple charges your Apple ID, unless you turn off auto-renewal in your Apple ID subscription settings at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the current period ends. Cancelling stops future charges, and you keep PRO until the end of the period you have paid for.

  • Promotions. An introductory or pre-launch offer, such as a discount for signing up before PRO launches, applies only on the conditions shown in the app when you accept it, and only for the period stated there.

  • Free trials. None are currently offered. If we offer one, its terms will be shown before you start. Any unused part of a trial ends when you buy a subscription.

  • Price changes. We may change prices. Apple will notify you, and will ask for your agreement where the law or Apple’s rules require it, before a change applies to your subscription.

  • Refunds. Payments are processed by Apple under Apple’s terms. Refund requests go to Apple (reportaproblem.apple.com). This does not affect any refund rights you have under the law.

  • PRO benefits. PRO benefits are subject to the conditions shown in the app, such as a free first session with a participating trainer or free gym days at participating gyms. They depend on the Provider taking part, and on the attendance rules in section 4. Unused benefits do not roll over, and they end when your subscription ends. They have no cash value.

  • One-time purchases such as streak freezes are used up when used, have no cash value and are not transferable.

  • Changes to PRO. We may change what PRO includes. If we remove a significant feature during a period you have paid for, we will tell you.

8. Trainly itself

  • Trainly, including its software, design, exercise library, logos and the name “Trainly”, belongs to Trainly Fitness Inc. or its licensors. You may not use our name or logos in a way that suggests we endorse you, without our written permission. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own use.

  • We are always improving Trainly, so features may be added, changed or removed. We aim to keep Trainly available and secure, but we cannot promise it will always be available, uninterrupted or error-free. Keep your own copies of anything important to you.

  • Trainly may show content or links from others, and may let you import data from other apps. We are not responsible for third-party services or their terms.

  • Test versions and new features. Pre-release versions (for example through Apple’s TestFlight), and features we label as beta or early access, may have bugs. We may change or remove them at any time, and you use them at your own risk.

9. Disclaimers

To the fullest extent the law allows:

  • Trainly is provided “as is” and “as available”.

  • We make no warranties beyond those in these Terms, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement.

  • We do not guarantee the accuracy of any content, record or statistic, or the conduct, services or premises of any Provider or user.

10. Limitation of liability

To the fullest extent the law allows:

  1. No indirect losses. Trainly and its directors, officers, employees and agents will not be liable for:

    • indirect, incidental, special, consequential or punitive damages;

    • loss of profits, data or goodwill.

  2. Injuries and other people. We will not be liable for injury, loss or damage that arises from:

    • exercise or training;

    • any Provider’s services or premises;

    • any user’s conduct;

    • any booking or payment between you and a Provider.

    This does not apply where the injury, loss or damage was caused by our own negligence or wilful misconduct.

  3. Cap. Our total liability to you for all claims is limited to the greater of what you paid us in the 12 months before the claim arose and CAD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud. Nothing in these Terms affects your statutory rights as a consumer. In Quebec, these limits do not apply to the extent the Consumer Protection Act or the Civil Code of Québec do not allow them. In some US states some of these limits do not apply to you.

11. Indemnity

If you use Trainly as a Provider or business, you will reimburse Trainly for reasonable losses and costs (including legal fees) arising from:

  • your services;

  • your content;

  • your breach of these Terms or the law.

This section does not apply to consumers where the law does not allow it.

12. Ending your account

  • You can delete your account at any time in Settings → Delete account. See the Privacy Policy for what happens to your information.

  • We may suspend or close your account, or limit features, if:

    • you seriously or repeatedly break these Terms;

    • we must do so by law;

    • your conduct creates risk or legal exposure for Trainly or others;

    • we stop offering Trainly.

    Where reasonable, we will give you notice and a chance to download or remove your content first. If you think we made a mistake, contact us. While your account is suspended you can still delete it.

  • If we close your account without cause, or stop offering Trainly, we will tell you how to ask Apple for a refund of any unused, prepaid subscription period.

  • Sections 5 (for content already shared), 9, 10, 11, 13 and 15, and anything else that by its nature should continue, survive after your account ends.

13. Governing law and disputes

  • Talk to us first. Most problems can be fixed quickly. Please email support@trainlyfitness.com and give us 30 days to try to resolve it.

  • Governing law. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules.

  • Courts. Disputes will be decided by the courts of Alberta. However:

    • if you are a consumer, you may bring a claim in the courts where you live, and the consumer protection laws of your province, state or country continue to apply;

    • if you live in Quebec, Quebec law applies to the extent the Consumer Protection Act and the Civil Code of Québec require, and you may bring a claim in Quebec.

  • These Terms do not require arbitration or prevent you from joining a class action where the law allows it.

  • California users. Under California Civil Code section 1789.3, if we have not resolved a complaint, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210.

14. Changes to these Terms

We may update these Terms as Trainly changes or as the law requires. If a change is significant, we will tell you in the app at least 30 days before it takes effect, unless it is needed sooner for legal or safety reasons. Any change will not apply to disputes that began before it.

If you keep using Trainly after a change takes effect, you accept the new Terms. If you do not agree, you can delete your account before then. Where the law requires your express consent, we will ask for it.

15. General

  • These Terms and the Privacy Policy are the whole agreement between you and Trainly about Trainly.

  • If a court finds part of these Terms unenforceable, the rest still applies.

  • If we do not enforce a term straight away, we have not given up the right to enforce it later.

  • You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, and your rights continue.

  • We are not responsible for delays or failures caused by events outside our reasonable control.

  • Notices we give you in the app or by email count as “in writing”.

  • Nothing in these Terms creates a partnership, employment or agency relationship between you and Trainly.

  • Language. These Terms are available in English and French. Where both exist, each is equally authoritative. Les présentes conditions sont disponibles en français et en anglais.

16. Apple App Store

If you downloaded Trainly from the Apple App Store:

  • These Terms are between you and Trainly, not Apple. Trainly, not Apple, is responsible for the app and its content.

  • Your licence to use the app is limited to Apple-branded devices you own or control, as Apple’s Usage Rules allow.

  • Apple has no obligation to provide maintenance or support for the app.

  • If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.

  • Apple is not responsible for:

    • any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, and consumer protection or privacy claims;

    • any claim that the app infringes someone’s intellectual property. Trainly is responsible for investigating and resolving such claims.

  • You confirm that:

    • you are not in a country subject to a US government embargo, or designated as a “terrorist supporting” country;

    • you are not on any US government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
